Keller and Heckman Introduces Prop 65 Pulse, a Monthly Newsletter Exploring Trends in California’s Proposition 65 Notices
—San Francisco— International regulatory law firm Keller and Heckman LLP recently released the firm’s newest publication, Prop 65 Pulse. Authored by Partners in the firm’s San Francisco office Sophie Castillo and Mitzi Clark, the monthly newsletter explores trends in California’s Proposition 65 (“Prop. 65”) surrounding claims, chemicals, products, and more.
Officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, Prop. 65 requires, among other things, sellers of products to provide a “clear and reasonable warning” if use of the product results in a knowing and intentional exposure to one of more than 900 different chemicals “known to the State of California” to cause cancer or reproductive toxicity. Prop 65 Pulse focuses on the bounty hunter provision of Prop. 65, which permits enforcement of the law by private individuals.
“Prop 65 Pulse provides readers a compendium of the ongoing trends in bounty hunter activity,” explained Partner Sophie Castillo. “Each month, we compile noteworthy Notices of Violation sent to product manufacturers, distributors, and retailers in the last 30 days. Each issue is organized in a digestible format, allowing readers the ability to quickly identify violations most relevant to their industry.”
Keller and Heckman has been assisting clients with Prop. 65 matters since the law was enacted in 1986. The firm has robust FDA, Chemical Control, Environmental, and Pesticides regulatory practices with extensive experience in all aspects of Prop. 65 compliance and risk management, as well as in defense of Prop. 65 claims.
Mitzi Clark, Partner and Manager of the San Francisco office, commented on the benefits of working in one of the most stringent regulatory climates in the nation, adding that the team can provide “tailored Prop. 65 services to a wide range of industries, including food and beverage, cosmetics and personal care, consumer products, chemical products, e-vapor and tobacco products, household products, plastics, and retail distribution. Prop 65 Pulse caters to these same industries.”
