Katie Bond, Samuel Butler, and Kristina Everett Author a WLF Legal Pulse Article on Use of the Word ‘Natural’
Keller and Heckman Partner Katie Bond, Associate Samuel Butler, and Law Graduate Kristina Everett authored a Washington Legal Foundation (WLF) Legal Pulse article, “The Reasonable Consumer: What Does ‘Natural’ Really Mean?” The article discusses a recent decision out of the Southern District of New York where plaintiffs “failed to establish what ‘natural’ might mean to a reasonable consumer.” The article also points out that “this is not the first case where plaintiffs have tried unsuccessfully to make a definition stick,” and that “companies will continue to use the term ‘natural’ so long as it carries broad appeal to consumers.”
Katie, Samuel, and Kristina encourage companies to “provide themselves with some protection and an awareness of the risks they are incurring with their ‘natural’ marketing by staying abreast of the numerous class action filings in this area.”
