Keller and Heckman Senior Counsel Peter de la Cruz and Partner Sheila Millar authored the Environmental Law Reporter article, “Why Sustainability Needs Antitrust.” The article demonstrates how both sustainability and antitrust “share fundamental conceptual similarities” and have “laudable goals,” but neither concept “presents a precise answer to how their goals are best achieved in any particular situation or when past solutions need to be reconsidered for changing circumstances.”
Peter and Sheila argue that there is a strong relationship between sustainability and antitrust, and that antitrust is needed in order to maintain modern markets that support competitive-driven efficiencies and innovation. “Antitrust,” they write, “can be a helpful tool in finding the optimum balance among sustainability’s goals.”
