Peter Craddock Quoted in Lexology PRO Article on Belgian Regulator Decision

Keller and Heckman Partner Peter Craddock was quoted in the Lexology PRO article, “Belgian regulator shuts down noyb-backed complaint.” The article discusses the Belgian Data Protection Authority’s decision to dismiss a complaint by privacy NGO noyb over the transfer of personal data to the United States.

Peter told Lexology PRO that the Belgian regulator is making a point that representative organizations should not try to create a workaround under article 80(1) GDPR in the place of article 80(2) GDPR if member states have chosen not to implement it.

Peter commented that the authority had similarly rejected a noyb complaint in a previous decision relating to cookies. In the January decision, the regulator had noted that the complainant had not acted autonomously when visiting the websites in question but did so in the context of an internship at the organization.

“The regulator is raising the question: is the representative organization really just seeking to facilitate complaints or is it actively looking to be an enforcer in its own right?” Peter concluded.
