Manesh Rath and Taylor Johnson Quoted in Inside OSHA Article on OSHA’s Planned Interim Final Rule
Keller and Heckman Partner Manesh Rath and Associate Taylor Johnson were quoted in the Inside OSHA article, “Employer Attorneys Doubt OSHA’s Planned Interim Rule on Subpoena Power.” The article refers to Keller and Heckman’s May 17, 2023 OSHA 30/30 webinar, which focused on OSHA’s plan to soon issue an interim final rule (IFR) which is expected to provide clarity on its use of subpoenas. The article discusses Manesh and Taylor’s analysis of the planned IFR, given that it will come without a notice and comment period. “Because it is an interim final rule, there will be no rulemaking, and therefore no opportunity for stakeholders to comment on these unknown changes…It’s very hard to gauge the scale of the changes that OSHA is hoping to slip in without rulemaking,” explained Manesh. Taylor added, “I certainly can’t remember a time when there’s been something so potentially important here with so little information released about it. So there’s been a lot of speculation to this point as to what will be in this interim final rule.”
