Manesh Rath and Taylor Johnson Quoted in Inside OSHA Article on an Occupational Safety and Health Review Commission Decision Regarding the Crane Standard
Keller and Heckman Partner Manesh Rath and Associate Taylor Johnson were quoted in the Inside OSHA article, “5th Circuit Weighs OSHA Enforcement Action Testing Crane Standard Reach.” The article states that a Texas construction firm, TNT Crane & Rigging, is suing over the Occupational Safety and Health Administration’s (OSHA) citation for a 2016 crane accident, after the Occupational Safety and Health Review Commission (OSHRC) rejected the employer’s defenses twice. The article refers to Keller and Heckman’s July 20, 2022 OSHA 30/30 webinar, where Manesh and Taylor discussed and evaluated several of the arguments presented by TNT Crane & Rigging and offered pragmatic guidelines for other employers to implement. Taylor noted that OSHA inspectors gathered their information for the citation solely from interviews, and never actually visited the scene of the 2016 accident. Manesh added, “TNT’s employees, when interviewed, have to be able to respond in a manner that is truthful and cooperative with the agency that is conducting this investigation. However, TNT should train its employees… [so] that the truth is preserved, and that it is described not misleadingly.”
