Lawrence Halprin Quoted in EHS Today Article on OSHA Amazon Citations
Keller and Heckman Partner Lawrence Halprin was quoted in the EHS Today article, “Regulatory Update: OSHA Cites Amazon for Medical Mismanagement.” The article explains how the Occupational Safety and Health Administration (OSHA) uses the General Duty Clause to target work processes designed for speed, not safety – most notably at Amazon’s distribution centers. The article references Lawrence’s May 2, 2023 client alert in which he states, “In taking this approach, OSHA apparently believes it has a better chance of sustaining General Duty Clause citations based on medical mismanagement of employee injuries than on demonstrating that the underlying job presents a recognized hazard for musculoskeletal disorders.”
Lawrence stresses that employers who utilize onsite workplace clinics or similar arrangements should make sure the worksites have appropriate medical protocols which are documented and properly implemented. He then added, “If an OSHA inspector hands your site representative a medical access order, it would be prudent to consult legal counsel.”
