Lawrence Halprin Quoted in Bloomberg Law Article on OSHA’s HazCom Rule
Keller and Heckman Partner Lawrence Halprin was quoted in the Bloomberg Law article, “Chemical Makers, Employers Brace for OSHA ‘HazCom’ Rule Fallout.” The article discusses the Occupational Safety and Health Administration’s (OSHA) latest update to its rules on communicating hazards, or HazCom. Under this new rule, chemical manufacturers and importers are required to list on warning labels the chemical reactions and dangers that occur when the chemical is mixed with other compounds.
“The effort that would be required to determine all the downstream reactions” that might be involved with a particular chemical “is absurd,” commented Lawrence.
According to Lawrence, the rule could be challenged on the basis that OSHA didn’t do a thorough economic feasibility study into the costs for manufacturers to determine how others might use their products.
