Keller and Heckman Partner James Votaw Quoted in InsideEPA Article on EPA’s Plans for PFAS

Keller and Heckman Partner James Votaw was quoted in the InsideEPA article, “Attorneys Downplay Near-Term Impacts of EPA’s RCRA PFAS Plans.” The article discusses the US Environmental Protection Agency’s (EPA) plan to address per- and polyfluoroalkyl substances (PFAS) under the Resource Conservation & Recovery Act (RCRA). According to James, “EPA will need to complete a rulemaking demonstrating that the selected PFAS have been shown in scientific studies to have toxic, carcinogenic, mutagenic or teratogenic effects on humans or other life forms” to classify a substance as a hazardous constituent under RCRA before listing it as a hazardous waste. He also explained that systems for waste management need to be in place before labeling the substances to avoid disruption.
