Keller and Heckman Partner Herb Estreicher was quoted in the InsideEPA article, “EPA, environmentalists continue talks in PMN suit.” The article discusses the lawsuit, first filed in March 2020, that environmentalists have filed against the US Environmental Protection Agency (EPA) over transparency concerns surrounding the Agency’s new chemical pre-market review program under the Toxic Substances Control Act (TSCA). Agency officials have been discussing possible settlement terms with environmentalists in the hopes of reaching some level of agreement regarding the EPA’s authority over such matters. According to Herb, “The environmentalists are asking for a very, very wide range of relief here, . . . and it does sound like some sort of settlement is on the horizon.”
