Herb Estreicher Quoted in Inside TSCA Article on Encouraging TSCA to Apply ‘Natural’ Exemption to Biofuels
Partner Keller and Heckman Partner Herb Estreicher was quoted in the Inside TSCA article, “EPA Faces Renewed Calls to Apply TSCA ‘Natural’ Exemption to Biofuels.” The article surrounds the U.S. Environmental Protection Agency’s (EPA) policy which subjects biofuels to pre-manufacture notices (PMN) under the Toxic Substances Control Act (TSCA). During Keller and Heckman’s March 23, 2022, TSCA 30/30 webinar, Herb stated, “Notwithstanding EPA’s best efforts, its willingness to streamline [the PMN review process], I suspect that it will still be the case that many biofuels will be considered new chemicals and will have to go through the PMN process, probably unnecessarily so, and that many of them will be regulated.” While the Agency announced that it will try to simplify the review process for biofuels under TSCA by creating a dedicated team, Herb argued that the EPA should instead exempt more biofuels as “natural products.”
