Herb Estreicher Quoted in Article Regarding Caution Urged with Compliance of Chemical Laws
Keller and Heckman Partner Herb Estreicher was quoted in the Bloomberg Law article, “Chemical Makers Urged to be Cautious When Complying with U.S., European Laws.” The article discusses how multinational chemical manufacturers complying with U.S. law and the EU registration, evaluation, and authorization of chemicals (REACH) regulation need to be careful that they do not inadvertently lose money by unnecessarily making toxicity data public.
REACH means “data is worth money,” Herb said in clarifying an explanatory note issued September 20 by The European Chemical Industry Council (CEFIC). CEFIC reminded U.S. chemical manufacturers that the toxicity data they or other companies find as they gather information required under REACH could trigger reporting obligations under the U.S. Toxic Substances Control Act (TSCA).
