Herb Estreicher and Lawrence Halprin Quoted in Inside TSCA Article on EPA Looking to OSHA to Enforce TSCA

Keller and Heckman Partners Herb Estreicher and Lawrence Halprin were quoted in the Inside TSCA article, “EPA Eyes OSHA As Model For TSCA Enforcement, Drawing Call For MOU.” The article describes the U.S. Environmental Protection Agency’s (EPA) plan to model the Agency’s risk management rules under the Toxic Substances Control Act (TSCA) after the Occupational Health and Safety Administration’s (OSHA) workplace chemical-exposure limits. During Keller and Heckman’s June 8, 2022 TSCA 30/30 webinar, Lawrence said that worker safety “would be better served” if the two agencies work in tandem. He further explains, “So while opinions vary, this one will be solely mine, long term, it appears industry needs to consider the possibility that industry and workplace safety would be better served by encouraging EPA and OSHA to develop a formal MOU and cooperate together in developing and enforcing rules governing workplace exposures to toxic chemicals.” Herb offered an opposing viewpoint arguing, OSHA should “step up” its own regulatory actions instead of yielding authority to EPA.
