Herb Estreicher and David Fischer quoted in InsideEPA article on Doubt regarding EPA’s Support of Epidemiological PFAS Tests Under TSCA
Keller and Heckman Partner Herb Estreicher and Counsel David Fischer were quoted in the InsideEPA article “Attorneys Doubt EPA Backs TSCA Petition for Epidemiological PFAS Tests.” The article discusses the likelihood that the U.S. Environmental Protection Agency (EPA) will grant a petition for assessments of 54 per- and polyfluoroalkyl substances (PFAS) under the Toxic Substances Control Act (TSCA) and the subsequent industry doubts that the Agency will order human epidemiological studies during the testing process. Herb and David said that they doubt the EPA will fully approve the petition. According to David, this doubt stems from the belief “that EPA would be … wanting to be very careful as to how they reconcile their decision regarding this petition with all the activities they have underway to deal with PFAS.”
