Herb Estreicher and David Fischer Quoted in Inside TSCA Article on TSCA Implementation Under Trump EPA

Keller and Heckman Partner Herb Estreicher and Counsel David Fischer were quoted in the Inside TSCA article, “House GOP Moves Quickly On TSCA Implementation Under Trump EPA.” The article emphasizes the significance of the next year in terms of revisions to the Toxic Substances Control Act (TSCA), with David noting that the 2025-26 span “is the window for something to happen if something is going to happen.” Echoing that sentiment, Herb noted that a Republican trifecta offers a “once-in-a-lifetime opportunity” for reform to the toxics law.

Herb and David both mentioned that the TSCA Improvement Coalition is seeking a range of changes to TSCA, with defining “unreasonable risk” as a major priority. Other revisions could include requiring EPA to consider costs in risk management rules; easing the test for the agency to find risk from new chemical uses; and reforms to statutory provisions that allow new-chemical applicants to seek refunds of the fees they pay for those submissions, among other targets.
