Herb Estreicher and David Fischer Quoted in Inside TSCA Article on Opportunity to Amend TSCA

Keller and Heckman Partner Herb Estreicher and Counsel David Fischer were quoted in the Inside TSCA article, “Industry Attorneys See ‘Once-In-A-Lifetime’ Chance To Rewrite TSCA In 2025.” The article refers to Keller and Heckman’s December 4, 2024, TSCA 30/30 webinar, where Herb and David emphasized the need to start advocating for amendments to the Toxic Substances Control Act (TSCA) now. Herb stated that GOP control of the White House and Capitol Hill provides a “once-in-a-lifetime opportunity to obtain a legislative fix to the problems plaguing TSCA’s workability.”

In order to improve the status quo of TSCA implementation, David and Herb have formed a TSCA Improvement Coalition made up of various chemical companies and organizations. Similar to Herb, David stressed the importance of acting fast, saying that the incoming administration will provide “an opportunity to initiate constructive dialogue, to cast a spotlight on TSCA implementation challenges.” He added that the coalition already has “a lot of data as to what’s working and what isn’t working, so I don’t think we need to really wait any longer for us to start rolling up our sleeves and figuring out what needs to change.”

David mentioned that the coalition is seeking many different revisions to the toxics law, including a statutory definition of “unreasonable risk” and a streamlined process for new chemical reviews, among other issues.
