Herb Estreicher and David Fischer Quoted in Chemical Watch Article on TSCA Test Orders
Keller and Heckman Partner Herb Estreicher and Counsel David Fischer were quoted in the Chemical Watch article, “US EPA forecasts issuing 14 TSCA test orders annually in coming years.” The article describes the U.S. Environmental Protection Agency’s (EPA) plan to issue approximately 14 Toxic Substances Control Act (TSCA) test orders per year until 2026. The majority will focus on per- and polyfluoroalkyl substances (PFAS), although Herb noted that the agency should be moving faster when it comes to PFAS. “There is an urgent need to collect real-world data on as many different types of PFAS as possible,” Herb said. This information could “potentially blunt the states and the EU in their push to ban PFAS as a class.”
Herb and David also commented on the manufacturer-requested risk evaluations (MRREs) process, with Herb observing that “applying the whole chemical approach to MRREs has basically killed it as an option of interest to industry.” David added that “it makes no sense for any company to submit an MRRE.”
