David Fischer Quoted in Inside TSCA Article on TSCA Risk Evaluation of Formaldehyde

Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “Industry Criticizes Final TSCA Formaldehyde Review’s Methodology.” The article discusses the U.S. Environmental Protection Agency’s (EPA) final Toxic Substances Control Act (TSCA) risk evaluation of formaldehyde and why it is drawing criticism. 

According to David, “There’s a lot in the risk evaluation that was not addressed when it was issued as final.” He noted that it “still reflects the whole chemical approach, still reflects overly conservative exposure assumptions, still reflects the notion that the failure to assume or take into account that occupational exposures are governed by OSHA standards.”

Through the TSCA Improvement Coalition, David is looking to push for TSCA reforms, especially as a new administration comes in. “At the end of the day, we’re going to need Congress to step in and further amend TSCA so we don’t get into situations where one administration assumes ‘A’ and then the next administration assumes ‘B,’” he stressed.
