David Fischer Quoted in Inside TSCA Article on TSCA Pre-Prioritization
Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “Industry Figures See EPA Gaining TSCA ‘Breathing Room’ In Pre-Prioritization.” The article indicates that the U.S. Environmental Protection Agency (EPA) is nearing the deadline for public input on the list of 27 chemicals it will consider for the Toxic Substances Control Act (TSCA) prioritization in 2025. “This whole notion of pre-prioritization was something that was inevitable, because EPA clearly needs more time,” said David in an interview with Inside TSCA.
“I’m glad to see the agency is moving toward front-loading things [and] trying to give itself a little more breathing room than it currently has,” he added.
EPA is taking comments through October 31 on its 27 pre-prioritization candidates. By mid-December, EPA plans to pick five chemicals to move through the TSCA prioritization process. “Maybe they’ll pick one or two that will require data, but you don’t want to overload the system where you’re doing . . . a boatload of test orders for chemicals when you could have picked a chemical for prioritization that has a real rich database,” commented David.
David also emphasized that EPA’s prioritization and evaluation of this batch of chemicals are contingent on the results of the presidential election.
