David Fischer Quoted in Inside TSCA Article on Settlement Deadlines for TSCA Evaluations
Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “Court Approves Aggressive Settlement Deadlines For TSCA Evaluations.” The article notes that a federal judge has approved deadlines to complete more than 20 past-due Toxic Substances Control Act (TSCA) risk evaluations (REs) over the next two years. The U.S. Environmental Protection Agency (EPA) must finalize three TSCA evaluations by the end of December and a fourth by January 15, 2025. EPA is also required to issue at least six draft risk evaluations, including 1,3-butadiene, by the end of December.
“I frankly don’t see how it is practical for EPA to abide by the December deadline, in particular, given all the work and input needed to produce quality draft risk evaluations that can measure up to peer review,” David told Inside TSCA. “Even if EPA can ably meet the December 2024 deadline, I find it improbable that the new EPA administration would not seek to revise all of the REs, even the final ones.”
