David Fischer Quoted in Inside TSCA Article on Push for TSCA Amendments
Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “Industry Attorneys See GOP Trifecta Boosting Push For TSCA Amendments.” The article refers to Keller and Heckman’s recent seminar, Navigating TSCA: Basics and Beyond, where David noted that he expects legislative amendments to TSCA to be on the agenda for the 119th Congress. “Unfortunately, [TSCA reform] was not done well the first time around in 2016,” said David. “Maybe this time we’ll get things right.”
David argued that TSCA could benefit from revisions in several areas, including the evaluation and risk management processes, and procedures and timelines in Section 6.
“EPA has no statutory authority to pull out a chemical once the formal prioritization process has started, which is a little odd,” said David. “Administrations change, priorities change . . . but that’s not really doable under the current statute.”
