David Fischer Quoted in Inside TSCA Article on Partisan Splits Complicating TSCA Reform
Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “Industry, Partisan Splits Complicate TSCA Reform As Panels Draft Bills.” The article mentions that industry sources are worried the current political climate might make it difficult to reach a bipartisan agreement that will be critical in enacting any new legislation regarding the Toxic Substances Control Act (TSCA).
David, head of the TSCA Improvement Coalition, noted that there is a “full awareness” of those involved “that you’re going to need some Democratic support because you need to hit that magic number 60” to pass the Senate over a filibuster threat. “Nothing is going on that’s not acknowledging that reality.”
While the coalition is interested in amending problems with the new chemicals program, they are also considering chemicals “more broadly” in the statute. “There are opportunities to also work on section 6,” which governs EPA’s evaluation and regulation of existing chemicals, as well as “some other aspects of TSCA that might need to be tweaked that weren’t amended before. Maybe now is an opportunity to look at these other sections too,” said David.
“You can still do surgery in each provision without completely revamping TSCA. I’d just hate to miss this opportunity to make these additional changes,” he added.
