David Fischer Quoted in Inside TSCA Article on EPA’s New-Chemical Rule Rework
Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “EPA Readies New-Chemical Rule Rework ‘This Spring,’ After Industry Petition.” The article discusses a letter from Madison Le, director of the U.S. Environmental Protection Agency’s (EPA) New Chemicals Division, that states that the agency will “consider” the petition submitted by David Fischer, Herb Estreicher, and James Votaw, which seeks to speed up reviews among other changes.
“I am hopeful that EPA will give the petition a hard look as it develops the draft Part 720 rule changes,” commented David. He added that the petition’s “main goal is to jump-start the conversation” on EPA’s long-promised update to the rules governing new-chemical reviews, in order to put industry in a position where it is proactive and “not having to react to a proposed rule.”
The petition is “our way of saying let’s change the regulation, not the statute, to move things along,” concluded David.
