David Fischer Quoted in Inside TSCA Article on EPA’s Listing of 1-BP as Hazardous Air Pollutant
Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article “Attorney Sees 1-BP Air Listing Potentially Weakening TSCA Regulation.” The article discusses the U.S. Environmental Protection Agency’s (EPA) listing of 1-bromopropane (1-BP) as a hazardous air pollutant (HAP) and how that listing might impact risk management regulations under the Toxic Substances Control Act (TSCA). While no risk management rules have been implemented yet for any of the initial 10 risk evaluations, David believes the Biden Administration could establish a rule to defer risks to the air office. But David cautioned that it’s currently unknown what approach the EPA will take – or if the “regulatory nexus concept will survive in risk management.”
