David Fischer Quoted in an Inside TSCA Article on EPA Proposal to Narrow TSCA Peer Reviews

Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “EPA Proposal To Narrow TSCA Peer Reviews Draws Fire From All Sides.” The article discusses the U.S. Environmental Protection Agency’s (EPA) proposal to overhaul the Toxic Substances Control Act (TSCA) “framework” for risk evaluations of existing chemicals.

The proposal includes limiting “repeated” review of scientific approaches it uses for multiple chemicals, which environmentalists and industry attorneys alike are saying could undermine the scientific rigor of TSCA evaluations.

“I get the peer review thing is massively time consuming,” noted David. “It’s clear EPA is trying to figure out how to shorten the time frame. But ironically, it’s a bit fraught with peril to mess with peer review. [The proposal] seemed a little unclear and that’s where EPA was giving itself a whole lot of discretion, when it would decide whether peer review was needed.”
