David Fischer Quoted in Inside TSCA Article on Deadline for TSCA Evaluations

Keller and Heckman Counsel David Fischer was quoted in the Inside TSCA article, “EPA Seeks More Time On Two TSCA Evaluations After Critical Peer Review.” The article notes that the U.S. Environmental Protection Agency (EPA) is currently seeking more time to develop one draft and one final Toxic Substances Control Act (TSCA) risk evaluation. Instead of completing both by the end of December 2024, EPA is asking to extend the deadline by approximately three more months.

In a November interview with Inside TSCA, David predicted EPA being unable to meet the December 2024 deadline: “I frankly don’t see how it is practical for EPA to abide by the December deadline, in particular, given all the work and input needed to produce quality draft risk evaluations that can measure up to peer review,” he said.

“Even if EPA can ably meet the December 2024 deadline, I find it improbable that the new EPA administration would not seek to revise all of the [risk evaluations], even the final ones,” David added.
