David Fischer Quoted in Greenwire Article on Tweaking TSCA
Keller and Heckman Counsel David Fischer was quoted in the Greenwire article, “Chemical industry aims for ‘surgical tweaks’ to chemicals law.” The article indicates that the chemicals industry is starting to push for changes to the Toxic Substances Control Act (TSCA). “Another round of reform is going to be inevitable,” said David. “There just seems to be too much room in TSCA to interpret what folks think Congress intended.”
David refers to the current TSCA as “a bit of a mess … in terms of less clarity, workability, timelines that are unrealistic, scopes of risk evaluations that are unrealistic, etc.” To address these shortcomings, David has created a TSCA Improvement Coalition, which is made up of several manufacturing companies. They are currently working on a list of reform recommendations.
David said he “is not talking to any lawmakers yet,” but has been in touch with Senate Environment and Public Works Committee staffers. “It may be a little premature for us to start reaching out to some of the key players. This is going to take some time, but you never quite know when there's an opportunity to at least start making legislative fixes, so you've got to come up with language,” said David.
