David Fischer Quoted in Bloomberg Law Article on Unforeseen Impact of EPA's Chemical Rules
Keller and Heckman Counsel David Fischer was quoted in the Bloomberg Law article, “Unforeseen Impact of Chemical Rules Revealed in Energy Near Miss.” The article discusses the unforeseen impacts of the U.S. Environmental Protection Agency’s (EPA) new chemical rules on nearly all industries and how their additional proposed rules could affect consumer, commercial, and industrial goods. Amid a recent near miss with the U.S. energy supply, many are urging companies to begin the process of understanding whether these new regulations will apply to chemicals in their supply chains. David explained that “Other regulatory details that could trip companies up include limits on the amount of a chemical that workers can be exposed to.” He goes on to say, “If a chemical’s production or the way it’s used can’t comply with the EPA’s workplace limits or otherwise sufficiently reduce the unreasonable risk, the Toxic Substances Control Act can require the EPA to prohibit it.”
The EPA will host a webinar on June 7 to discuss one of the proposed rules, however, the article details the importance of industry making efforts to meet EPA’s objectives even before there are final rules. “EPA would be disinclined to do a separate rule just for you, because you took too long to figure out what was happening,” said David.
