Azim Chowdhury Quoted in Vapor Voice and Filter Articles Regarding FDA’s New Authority Over Synthetic Nicotine Products

Keller and Heckman Partner Azim Chowdhury was recently quoted in the Vapor Voice article, “Biden Expected to Sign De Facto Synthetic Ban Tuesday” and the Filter article, “The FDA Has 120 Days to Regulate Synthetic Nicotine. That’s Impossible.” Both articles discuss the recently enacted $1.5 trillion spending bill, which includes a provision that redefines a “tobacco product” under the Food, Drug, and Cosmetic Act as “any product made or derived from tobacco, or containing nicotine from any source, that is intended for human consumption.” The requirements of the Tobacco Control Act now apply to synthetic (non-tobacco derived) nicotine e-cigarettes and other products. Most critically, manufacturers of synthetic nicotine products have until May 14, 2022, to submit premarket tobacco product applications (PMTAs). Products subject to timely submitted applications can remain on the market until July 13, 2022, after which they become subject to FDA enforcement if they have not received a marketing grant order from the Agency.
