Partner Azim Chowdhury was quoted in the Law360 article, “Synthetic Nicotine Industry Could Be Set To Evaporate.” The article discusses the U.S. Food and Drug Administration’s (FDA) upcoming Premarket Tobacco Product Application (PMTA) deadline set for May 14, 2022, which could ultimately result in the removal of synthetic (non-tobacco derived) nicotine products from the vaping market. According to Azim, in PMTA submissions to the Agency, companies marketing synthetic nicotine products have to provide evidence that their products can help smokers switch from traditional combustible cigarettes while navigating the potential risk of exposure to minors. Yet, as Azim explained, “it takes years to develop the data” needed to demonstrate a new vaping product is appropriate for the protection of the public’s health. He further said, “I think you’re going to see a lot of companies closing up” in response to this regulation.
