Telecom Predictions for 2014 -- Vol XI Issue 2

Although predicting the future is always a tricky business, the attorneys of Keller and Heckman LLP offer the following predictions for 2014 in the world of telecommunications.

“Since the FCC is unwilling to allocate new broadband spectrum for use by oil and gas companies, electric utilities, and others in the critical infrastructure community, perhaps 2014 will be the year private industry steps forward to address the problem.” 

“Under Chairman Tom Wheeler, expect the FCC to address and resolve more issues, more quickly.  No more paralysis of analysis.” – Doug Jarrett, Partner

"Telcos no doubt will do their best to exploit the FCC's new pole attachment rules, and some will ignore existing contract requirements until a court tells them otherwise." – Tom Magee, Partner

“The FCC will allow critical infrastructure companies to hold licenses in the 4.9 GHz band.  Although a relatively minor victory, the action will provide a roadmap for future CII efforts to access bands currently allocated to other users.” – Greg Kunkle, Partner

“Expect an increase in private lawsuits (class actions in particular), more enforcement by federal and state agencies, and more collaboration among the states arising out of privacy violations and data breaches.  In particular, expect more enforcement relating to mobile app privacy and data security in 2014.” – Tracy Marshall, Partner

“Looking back on the FCC’s enforcement trends throughout 2013, tower owners should be diligent in their efforts to properly register and maintain antenna structures with the FCC and FAA.” – Tim Doughty, FCC/FAA Licensing Specialist
