Telecom Business Alert -- Vol. IX Issue 1

Telecom Predictions for 2012

Although predicting the future is always a tricky business, the attorneys of Keller and Heckman LLP offer the following predictions for 2012 in the world of telecommunications.

"Broadband will drive FCC policy making. The Net Neutrality Order will be overturned on appeal. The Senate will confirm two Commissioner nominees. Congress will allocate the D-Block to Public Safety and authorize incentive auctions of licensed TV spectrum. The FCC will propose USF contribution reforms." –Doug Jarrett, Partner

"Pole attachment make-ready and rate disputes will increase as the FCC's new rules sink in." –Tom Magee, Partner

"The FCC will receive new authority from Congress for broadcast incentive auctions, freeing up spectrum currently used for TV broadcasts for broadband (both auctioned and unlicensed)." –Greg Kunkle, Partner

"It may be some time before a comprehensive federal privacy law is adopted, but we can expect that the FTC will continue to exercise its authority over unfair and deceptive practices with regard to companies' online information collection practices." –Tracy Marshall, Partner

"A major focus of the FCC's Wireless Bureau in 2012 will be narrowbanding. The Commission likely will continue reminding licensees of the mandatory January 1, 2013 deadline to cutover to narrowband technology and will deal with waiver requests on an individual basis." –Wes Wright, Associate
