Attorneys from Mackrell International member firms in the EU and United States will discuss some best practices for companies as they seek to understand the impact of the new EU-U.S. Privacy Shield principles on their operations and transition from the recently invalidated U.S.-EU Safe Harbor. Last fall, the European Court of Justice issued a landmark privacy ruling declaring the 2000 European Commission decision authorizing the Safe Harbor framework invalid.  The Safe Harbor framework allowed self-certified companies to transfer data about EU citizens to the United States.  Following months of negotiation on a new framework, the European Commission issued a draft adequacy decision on February 29, 2016, which established a new EU–U.S. Privacy Shield to ensure the adequate protection of the privacy rights of EU citizens.  This brings the EU and United States another step closer to finalizing an agreement to enable data transfers.
