With the TSCA “polymer exemption” and favorable review under the TSCA section 5 PMN review process, commercialization requirements for “new” polymers under TSCA historically have been less onerous than for non-polymers.  Last June’s enactment of the Frank R. Lautenberg Chemical Safety for the 21st Century Act, however, resulted in a significant change to EPA’s treatment of polymers.  From initially requiring an “upfront” 90-day toxicity study, to four new polymer categories with tiered testing and personal protective equipment (PPE) requirements, Tom Berger and Marisa Krieder discussed EPA’s evolving approach to new polymers under TSCA.
