Broadband Partnerships
Keller and Heckman attorneys have longstanding and extensive experience developing and negotiating a wide range of broadband partnerships, including public-public, public-private, and private-private partnerships at the state, regional, and local levels.
At the initial stage, we help clients identify their goals, assets, opportunities, needs, and preferences; develop partnership strategies; find potential partners through RFIs, RFQs, and RFPs or other means; explore funding opportunities; design appropriate organizational and governance structures; and develop and negotiate partnership agreements. We draw upon decades of knowledge and experience with broadband and telecommunications regulatory and business matters, and we use this background to advise clients about how to allocate partnership responsibilities, risks, and rewards pertaining to multiple financial, operational, and regulatory compliance issues. We also enable clients to implement their strategic and business goals by helping them to develop necessary agreements, including MOUs, partnership agreements, subrecipient agreements, affiliate transaction agreements, fiber leases and IRUs, franchise agreements, pole attachment agreements, service-related agreements (e.g., wholesale, retail service, reseller), and construction agreements.
