Catarina (Cat) Conran specializes in regulatory compliance under the Toxic Substances Control Act (TSCA), the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), and the Resource Conservation and Recovery Act (RCRA). Her work has included negotiations with the U.S. Environmental Protection Agency (EPA) to settle violations, including those disclosed under the “Audit Policy.” She regularly reviews risk management rules, most recently EPA’s asbestos part 1 and methylene chloride, to understand their impact on industry and firm clients.
During law school, Cat was an Editorial Board Member of the Virginia Law Review, as well as the Executive Editor for the Virginia Environmental Law Journal. In conjunction with her law degree, Cat earned a dual master’s degree in environmental science, which uniquely equips her to provide valuable insight to clients dealing with matters of technical complexity.
Representative Matters
- Guide clients through the premanufacturing approval process of chemicals under TSCA and pesticide registrations under FIFRA
- Respond to EPA Show Cause Letters after an agency inspection of a client’s facility, arguing that the violations they allege do not exist and presenting evidence in support thereof
- Advise clients on preparing for TSCA inspections and defending against enforcement actions to minimize civil penalties
- Assist in the drafting and submittal of self-disclosures under EPA’s Audit Policy
- Draft comments on significant EPA proposed regulations including risk management rules, SNURs, and 8(d) reporting rules
- Develop legal analysis regarding compliance with disposal of hazardous substances under the Resource Conservation and Recovery Act (RCRA)
- Research the RCRA rules surrounding generator classification (Large / Small / Very Small Quantity Generators) and when a site can qualify as an Episodic Generator
- Monitor federal and state regulatory and legislative developments regarding per- and polyfluoroalkyl substances (PFAS) to assist clients with meeting reporting requirements
